Licensing and Regulatory Regime
The licensing framework of insolvency practitioners under the Insolvency, Restructuring and Dissolution Act 2018 (“IRDA”) will be one where:
a) A public accountant and / or chartered accountant who is issued an insolvency practitioner’s licence will be allowed to undertake insolvency and debt restructuring appointments in:
(i) Court-ordered winding up;
(ii) creditors’ voluntary winding up;
(iii) receivership;
(iv) judicial management; and
(v) bankruptcy and voluntary arrangement cases.
b) A solicitor who is issued an insolvency practitioner’s licence will be confined to undertake insolvency appointments in bankruptcy and voluntary arrangement cases only.
Licence Conditions
Under section 52 of the IRDA, the Licensing Officer may impose conditions which he considers requisite or expedient to be complied with on the licences. This is in addition to the statutory requirements under the IRDA (including the subsidiary legislation).
Licence conditions are a set of administrative rules that a licensee must abide by if he wishes to (or continues to) hold the licence to act as an insolvency practitioner, and may apply to all licensees, a specified class of licensees or a specific licensee. It also seeks to establish a common and minimum set of standards of professional conduct a licensee is expected to uphold when undertaking insolvency and debt restructuring work under the IRDA.
